'Workplace of the Month' - Chargeback
The company "Chargeback" are June's 'Workplace of the Month'. Chargeback is a rather unique and innovative claims management company that specialises in the following types of claims: Unfair charges, such as Bank Account, Credit Cards, and Store Card charges, Financial Miss-selling that includes; faulty credit agreements, Payment Protection Insurance ("PPI"), and accident, sickness & unemployment insurance ("ASU"). Chargeback was created in early 2007 in response to the bank charge reclaiming revolution. Paul Beardsley, a manager at Chargeback noted how difficult financial institutions made it for customers to reclaim their charges. Chargeback wanted to perform this service for people hence taking the burden of claiming away from customers.

Test Case - Bank Charges Case update
July 2007 - The Office of Fair Trading ("OFT") started a court case against several large banks. Since this date bank charges claims have been on hold.

24 April 2008 - Fantastic news! The High Court judge, Mr. Justice Andrew Smith, confirmed what bank charges campaigners have been arguing for two years, that consumer contract regulations, known as 'Unfair Terms in Consumer Contracts Regulations' do apply to bank charges, meaning 'fairness' counts. While it's not the end of the line, it's a massive step and paves the way for the OFT to decide whether it thinks banks' charges are unfair.

22 May 2008 - Case Management Conference. At this point both parties have reconvened to discuss whether either wants to appeal, and how to proceed.


The test case does not strictly affect all types of claims. It is strictly only about reclaiming personal bank charges. Other types of cases such as credit cards, store cards and business bank accounts are unaffected. Even though claims are currently on hold, it's important to get in the queue. It's estimated there are already over 750,000 cases on hold, so when the floodgates do open, the further ahead you are in the queue, the sooner your claim will be processed. Currently there is just one Chargeback branch based right on your doorstep in the fantastic new offices situated in City Mills Business Centre, Peel Street, Morley. There are just five staff in total; Paul, Leanne, Laura, Christie and Sean working extremely hard every day. The team is tightly run and works closely together. The company is experiencing rapid growth and handle claims from customers from all parts of the UK, through the website www.charge-back.co.uk, they are constantly on the lookout to expand the team with bright young individuals.

All staff are provided with induction training to outline relevant case law and main issues in dealing with claims. The staff are trained individually and on a monthly basis together with regular ad hoc updates when necessary, so that they can provide customers with the most up to date information wherever possible.

Chargeback usually claim from financial institutes but believe it is in their and the customers' best interests to build good working relationships with these companies. They believe such claims are best resolved by negotiation. Therefore, have developed relationships with banks, financial governing bodies and solicitors to facilitate the process. Chargeback's largest claim to date was in respect of unfair charges on a business bank account and was in excess of £28,000.

Paul is an accountant, therefore Chargeback will shortly be offering a range of accountancy services to local businesses. Following that they will be rolling out a nationwide document delivery service to include process serving.

The future is looking bright for Chargeback! When customers recommend a friend for bank charges, credit cards and business claims, whoever refers a new claim is entitled to receive 5% of the total claim value upon successful resolution of the claim. This could be very fruitful - take for example the largest claim of £28,000. 5% of that would be £1,400. Worth thinking about...
